Terms & Conditions Agreement
Please read and agree to (by signing) the following Terms and Conditions which form part of the contract (“the Agreement”) you enter into by joining one of our tours.
I acknowledge and agree as follows:
1) My completed Booking Form, together with the required deposit must be received by Ride TopGear Pty Ltd -Vietnam Motorbike Tours to confirm my place on the selected tour.
2) The full balance is payable 55 days prior to departure. My booking may be considered cancelled if the full balance is not received by that time.
3) If I cancel my booking I must notify RIDETOPGEAR PTY LTD, by email. I accept that if I cancel my booking my deposit will not be refunded.
4) Should I wish to transfer to another RIDETOPGEAR PTY LTD, notification must be made by me in writing at least 55 days prior to departure. My full deposit will be credited to the new tour. Transfers later than this are not permissible and no refund will be given.
5) I am responsible for ensuring I am fit and healthy enough to participate in this trip. If I suffer from heart, chest, muscular or respiratory disorders, severe asthma or high blood pressure, I acknowledge that I should seek qualified specialist medical advice before joining the trip.
6) It may become necessary, due to weather, local conditions, politics or various other reasons, to make changes to trip itineraries. Such changes will always be at the discretion of the tour Leader, and no refund will be considered in the event of such changes.
7) Ride TopGear Pty Ltd and its agents take no responsibility for any flight delays or schedule changes at any stage throughout the trip. In the event of any such changes no refund will be considered and I must seek recompense through my own travel insurance.
8) The trip costs published within the chosen itinerary are accurate at the time of delivery and Ride TopGear Pty Ltd and its agents will endeavour to maintain those costs. However, in the event of currency exchange rate fluctuation, increased fuel costs, airport charges, increased airfares or increases in the costs charged by ground operators, Ride TopGear Pty Ltd reserves the right to amend it's prices up to the date of departure.
9) This Booking Form and “Agreement” is not issued on behalf of any airline, or other carriers however described and does not constitute any commitment on their behalf in the course of this trip.
10) The tour cost does not include travel or medical insurance. Travel Insurance is MANDATORY. It is my responsibility to hold suitable travel insurance cover which includes for motorcycle riding prior to commencement of the trip
11) The tour cost does not include passport or visa charges, insurance excess , extra baggage charges, incidental daily expenditure of a personal nature, or any other costs/charges not described or disclosed in the 'Prices Includes' section of the General Information portion of the tour literature supplied to me by Ride TopGear Pty Ltd
12) Vietnam Motorbike Tours Tourism Company is a privately owned Company. Ride TopGear Pty Ltd hold no indemnity insurance whatsoever. l and the other tour participants travel at their own risk and must hold adequate and appropriate travel insurance.
In signing this form I further acknowledge, agree and confirm the following:
a) I waive any and all claims I may have against, now or in the future, and Release from all liability and agree not to sue Ride TopGear Pty Ltd or it's directors, employees, guides, agents and representatives (collectively herein after referred to as 'Staff') for any personal injury, death, property damage, loss or inconvenience sustained by me as a result of joining this trip, due to any cause whatsoever including but without any limitation, or perceived negligence on the part of Ride TopGear Pty Ltd or it's agents.
b) This is an adventure tour. In addition to the usual dangers and risks inherent in travel, this tour has certain additional dangers and risks introduced by the nature of the tour. I accept all these inherent risks and the possibility of personal injury, death, property damage or loss resulting there from.
c) Should I suffer any serious injury or illness, Ride TopGear Pty Ltd can arrange at any cost to be borne by me, urgent medical treatment and emergency evacuation procedures as deemed essential to my safety.
d) In consideration of my Booking Form and deposit being accepted, I agree to all of the Terms and Conditions noted and described in this Release of claims, waiver of liability and assumption of risk (collectively, “this Agreement”).
e) In entering into this Agreement, I am not relying upon any oral or visual representation or statements by Ride TopGear Pty Ltd or it's staff or representatives or any other inducement or coercion to participate in this trip. I go only of my own free will.
f) I am over 18 years of age and have read, understood and accepted all the above noted and described Terms and Conditions of contract prior to signing this Agreement, and that this Agreement shall be binding upon my heirs and assigns, next of kin, executors, administrators and success-ors.
g) This Agreement l shall be governed in all respects in accordance with these rules .
h) I agree to hold valid travel insurance, which covers personal, medical and evacuation costs or expenses however required or described, and that it is valid for riding a motorcycle.
